Terms of Service — Storekept

These Terms of Service ("Terms") govern your access to and use of Storekept (the "App"), provided by Abdusamadbek Akhmadjonov, an individual based in Uzbekistan ("we", "us", "our", or the "Provider"). By installing or using the App, you ("Merchant" or "you") agree to these Terms. If you do not agree, do not install or use the App.
1. The Service
The App is an embedded Shopify application that:
- Automatically creates daily backups of your Shopify store data.
- Allows you to restore backed-up data into your store with one click.
The App backs up products, variants, collections, customers, themes and theme files, pages, blogs, articles, navigation menus, metafields, metaobjects, files/media, discounts, markets, and delivery profiles. See Section 4 for important limitations.
2. Eligibility and Accounts
You must have an active Shopify store and the authority to bind your business to these Terms. You are responsible for maintaining the security of your Shopify account and for all activity that occurs through your use of the App.
3. Subscriptions, Billing, Free Trial, Cancellation, and Refunds
3.1 Billing
Subscriptions are billed through Shopify Billing. By subscribing, you authorize Shopify to charge the applicable recurring fee for your selected plan tier. Fees, billing intervals, and plan features are described on the App's listing and pricing page.
3.2 Free trial
The App may offer a free trial for a stated period. Unless you cancel before the trial ends, your subscription automatically converts to a paid plan and the applicable fee is charged. Trial terms are shown at sign-up.
3.3 Renewal
Subscriptions renew automatically at the end of each billing period until cancelled.
3.4 Cancellation
You may cancel at any time from within the App or by uninstalling the App. Cancellation stops future charges. Access to paid features continues until the end of the current billing period unless stated otherwise.
3.5 Refunds
Except where required by applicable law, fees are non-refundable, including for partial billing periods and unused time. Any discretionary refund or credit is at our sole discretion; to ask about one, contact the support email in Section 15.
3.6 Price changes
We may change fees. We will give reasonable advance notice; changes take effect at your next billing cycle.
4. Important Service Limitations — Please Read
The App relies on the Shopify API, which imposes limitations we cannot work around. By using the App you acknowledge and accept the following:
4.1 Orders are export-only and cannot be restored
The App can export your order data as part of a backup so you retain a copy. However, orders can never be restored into a Shopify store. Shopify's API does not allow recreating orders. A restore operation will not, and cannot, write orders back into your store. Exported orders are provided for your records only.
4.2 Deleted collections are recreated, not undeleted
When a restore re-adds a collection that was deleted, the App creates a new collection with the backed-up data. It does not "undelete" the original. The recreated collection will have a new internal ID and may not preserve every association that depended on the original collection's identity (for example, references tied to the old collection ID).
4.3 General restore caveats
Restores depend on the current state of your store and the Shopify API at the time of restore. Some resources may be recreated rather than restored in place, and certain platform-managed identifiers, timestamps, or relationships may differ after a restore. The App provides a best-effort restoration and does not guarantee a byte-identical reproduction of your store.
5. Service-Level Expectations
We aim to provide a reliable service and run daily backups and monitoring. However, the App is provided on a commercially reasonable-effort basis. We do not guarantee:
- Uninterrupted or error-free operation.
- That every backup or restore will succeed in all conditions (e.g., during Shopify outages, API rate limits, or API changes).
- That backups capture data added between scheduled backup runs.
You remain responsible for verifying that your backups meet your needs and for maintaining additional safeguards appropriate to your business.
6. Your Responsibilities and Acceptable Use
You agree not to:
- Use the App in violation of any law, Shopify's terms, or third-party rights.
- Attempt to access data of stores you do not own or control.
- Reverse engineer, interfere with, overload, or attempt to gain unauthorized access to the App or its infrastructure.
- Use the App to store or process content that is unlawful or that you are not authorized to process.
- Resell or sublicense the App without our written permission.
You are responsible for the lawfulness of the store data you back up, including any personal data of your customers, and for having a valid basis to process it.
7. Data and Privacy
Our handling of data is described in the Privacy Policy and the Data Retention Policy, which are incorporated into these Terms by reference. You act as the data controller for store data; we act as your processor for that data.
8. Intellectual Property
The App, including its software, design, and documentation, is owned by us and our licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the App during your subscription. You retain all rights to your store data.
9. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW. WE DO NOT WARRANT THAT BACKUPS OR RESTORES WILL BE COMPLETE, ACCURATE, OR ERROR-FREE.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- We are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost revenue, lost data, or loss of goodwill.
- We are not liable for any inability to restore orders or for differences arising from collections being recreated rather than undeleted, as disclosed in Section 4.
- Our total aggregate liability arising out of or relating to the App or these Terms will not exceed the total fees you paid to us for the App in the twelve (12) months preceding the event giving rise to the claim.
Some jurisdictions do not allow certain limitations; in those jurisdictions our liability is limited to the maximum extent permitted by law.
11. Indemnification
You agree to indemnify and hold us harmless from claims, damages, and expenses arising from your use of the App, your store data, or your breach of these Terms or applicable law.
12. Suspension and Termination
We may suspend or terminate your access to the App if you breach these Terms, fail to pay fees, or use the App in a way that creates legal or security risk. You may terminate at any time by cancelling your subscription and uninstalling the App.
Upon termination or uninstall, your store data and backup snapshots are deleted as described in our Data Retention Policy (permanent deletion within 48 hours, consistent with Shopify's shop/redact webhook). Export any data you wish to keep before termination.
13. Changes to These Terms
We may update these Terms. Material changes will be communicated through the App or by email. Continued use of the App after changes take effect constitutes acceptance.
14. Governing Law and Disputes
These Terms are governed by the laws of Uzbekistan, without regard to conflict-of-law rules. Any dispute will be resolved in the competent courts of Uzbekistan, unless applicable law requires otherwise.
